Save the Bay fights to prevent drilling, dredging

From Page 1 vation of the bay. At a meeting in Coral Gables Monday night, Jan. 31, Save the Bay drew up a list of suggested rule changes that Malloy presented to the DNR Wednesday. The DNR's rules should have been based on the preservation act, but Save the Bay members say some of the rules bear little resemblance to articles in the act. In the past year, the DNR has drafted four sets of rules for use of the bay, none of which were acceptable to environmentalists. At Wednesday's workshop, environmentalists argued the following points: • Rules should not allow drilling and dredging in Biscayne Bay. Save the Bay would eliminate drilling entirely and put more stringent limitations on dredging. • Biscayne Bay should be controlled by Dade County. If the county controlled the second level of permits, Bay regulations could be more stringently enforced. Tallahassee is too far away to control the situation. • The current rule's definition of "extreme hardship" is ambiguous and could be interpreted to cater to special or private interests. The rules state that the regulations can be bent in cases of extreme hardship. "But in our rules, Fisher Island would be a case of extreme hardship, because it can't be developed without a large boat dock, which ordinarily would be against regulations," said Ms. Nancy Brown, a South Dade resident. • The present rule's definition of "public interest" is also ambiguous and could allow drilling for natural gas in the bay, if it were in the interest of the public anywhere. Save the Bay changed the wording to specify the public interest of people living in the Biscayne Bay area. • The present rules would allow a boat dock to extend 100 feet out into the bay. Malloy will ask that it be changed to only 15 feet. Biscayne Bay is governed by its own preservation act.
