S. Miami police officers file suit for overtime pay Cops' attorney says claims could amount to $250,000

By EDWIN KNIGHT Staff Writer Thirty five former and present City of South Miami police officers have filed suit against the city asking for back overtime pay, which could amount to $250,000. The suit is similar to, but more extensive than, a suit which was recently won by Metro police officers against Dade County. The suit was filed recently by Attorney Richard Bonehill, who also represents the South Miami Fraternal Order of Police Lodge in labor negotiations with the city, and is the counsel for a former officer in a suit against the city. The 35 officers allege in the suit that they were required to work at least a half hour overtime per day, and sometimes longer, without receiving overtime pay at the rate of time and a half or compensatory time off. This was done, the bill of complaint adds, even though city personnel rules and the city's code of ordinances require the paying of overtime or compensatory time off. Other departments in the city, the suit alleges, through their department heads, received the overtime or the compensatory time off. The officers are asking the circuit court to direct the city to account for the funds, establish a procedure for filing claims, pay overtime or compensatory time in the future and and pay attorney fees. Of the 35 officers bringing the suit, 19 are presently city police officers and 16 are former officers, who either were fired or have left the city's employ for various reasons.

"Six dollars isn't a lot of money, said Mrs. Goldberg; another Kendale Lakes resident being overcharged, "but why should I give it to them?" When Mrs. Goldberg first called Southern Bell's business office, they told her that the switching station was not yet in operation but that when it did begin to function, she would have the charge cancelled. "I don't know why our service representatives don't know about this," mused Self. "But if anyone has any trouble they should be able to get it straightened out."
