Failure To Pass Community Property Law Hit Gables Residents Hard, Says Lawyer

By GEORGE H. HENRY (Editor's Note: Mr. Henry is a Coral Gables attorney who has done a considerable amount of research on the community property law. It is his belief that Coral Gables residents would be particularly affected by the law. He has prepared the following article in the belief that it will be of interest to most readers of The Riviera-Times). The Florida state legislature deprived the people of the state of Florida of the benefit of a community property system by voting down in the Senate a community property bill introduced by Representative Walter S. Hardin. This was a blow to the state of Florida and more particularly to the residents of a city like Coral Gables. The average income of a wage earner who lives in Coral Gables is approximately $4,500 per year. It is at this income level that the benefits of a community property law is first realized. Therefore it is to the advantage of the people of Coral Gables to fully understand the principle of a community property system. Marriage a Partnership A community property system looks upon marriage as a partnership. Like a partnership all income or property received by either the husband or wife after marriage, is divided equally between them for tax purposes. This is true even though only one of the spouses is working. The saving in income tax occurs because larger incomes are taxed at a higher rate than low incomes. If you are able to divide your income into two halves, each half will be taxed at a lower rate. The tax saving results only to married people as only husbands and wives are able to divide their income under this system. The following example is an illustration of the tax saving which can be affected. John Smith married after all allowable deductions and exemptions, has to pay a tax on an income of $10,000. Under the law in effect in Florida today, John Smith has to pay a tax of $2,508. If Florida were a community property state, John Smith would pay a tax of only $2,090. He would pay the tax on $5,000 amounting to $1,045 and Mrs. Smith would pay the income tax on her $5,000, which would also amount to $1,045. Therefore, a saving of $418 would be gained by the Smiths. The saving is progressively greater as the amount of income increases as shown by the above chart. Deductions Divided As the income is divided equally between a husband and wife, the deductions allowable against the community property are likewise divided equally. The only beneficial effect a community property system has on Federal taxes is to reduce the amount of Federal income taxes. The Federal estate and gift taxes are in no way reduced, increased, or changed, when either the husband or wife dies in a community property state. As the community property ceases upon the death of either spouse or in the event of a divorce. Hardin Bill Representative Walter S. Hardin of Manatee county introduced a bill in the past state legislature which would have made Florida a community property state. The bill passed in the House by a wide majority, but was voted down by a close margin in the state Senate. The "Hardin bill" was, except for minor changes, an exact duplication of the community property law, which is working successfully in Oklahoma. Objection Cited There have been objections to a community property law from some sources because in the event of a divorce, the community property would be divided equally between a husband and a wife. Under the proposed community property law introduced by Representative Hardin that would not have been the result. The function of a divorce court would be undisturbed and any ruling made by such a court would not have been changed in any way by the "Hardin bill." The residents of Florida enjoy the unique advantage of having everything to gain and nothing to lose by the passage of a law similar to the "Hardin bill." Gables Elks Leave Tuesday For Portland

Coral Gables Elks Lodge will be represented by a delegation at the 79th National Convention in Portland, Oregon. Exalted Ruler Andrew T. Healy announced yesterday that four members will leave Coral Gables on July 8 to arrive in Portland for the four-day convention which opens July 14. Delegates Named In addition to Healy, other local Elks making plans for the trip to Portland are Walter W. Wigman, Past Exalted Ruler; Frank R. Habershaw and Earl M. DeNoon. Mrs. Healy, Mrs. Habershaw and Mrs. Wigman will also make the trip. The local delegation has reserved compartments on the Florida East Coast Railroad limited, leaving Miami at 2:45 p.m. July 8. To Advertise Gables During the Portland convention mammoth street parade and pageant on July 11, when most of the 25,000 convention delegates are expected to march, Exalted Ruler Healy and his local delegates will wear purple bands on their straw hats, bearing the name "Coral Gables." Following the close of the convention on July 17, members of the Coral Gables delegation will make a side trip enroute home in order to do some sightseeing at Yellowstone Park, Grand Canyon, Banff and Lake Louise. About 461,697,000 acres of the American forest area grows, or is capable of growing commercially valuable timber.

Sarah Folwell Is Soloist For Concert

Soloist for the third in a series of Miami Beach "pop" concerts, scheduled July 12 at 8:30 p. m. in Flamingo Park, Miami Beach, will be Sarah Folwell, well-known concert singer of this area. Mrs. Folwell, who has taught voice at the University of Miami School of Music from 1940 to 1944, is now teaching at the Miami Conservatory. She is also the church soloist at the All Soul's Episcopal Church of Belle Isle. With Symphony During her career, Mrs. Folwell has appeared with the University of Miami Symphony orchestra under the late Arnold Volpe and with the University of Miami Symphony band. She has sung frequently on the radio both here and in the North. The "pop" concert, which is under the auspices of the University of Miami, will also feature Robert M. Dr. William P. Smith Opens Gables Office

Dr. William P. Smith, formerly of Louisville, Ky., has moved to Coral Gables and is opening his office for the practice of internal medicine. He served four years in the Navy, and has had two and one half years as interne and resident at the Jackson Memorial hospital in Miami. He will be associated with Dr. T. D. Sandberg at 108 Avenue Giralda. Dr. Smith and his wife plan to become permanent Gables residents.

Ensign Larson Sees Australia

Ens. L. O. Larson, Jr., of 124 Avenue Menores, Coral Gables, visited Melbourne, Australia, while serving aboard the destroyer USS Laffey, the Navy Department announced today. The Laffey is part of Task Force 38. Comprised of 14 ships, the task force made the first large scale visit of U. S. warships to Australia since the end of the war.
