Gibbys Get Permit But Canal Waters Still Muddy
More than a dozen property owners abutting an undug canal claimed by the City of Coral Gables have filed a counter suit claiming ownership. Another group seeks to have the City's suit dismissed. "If legally they're entitled to it they should have it," City Attorney Ted Semple said Tuesday of the suit. Semple had filed his own suit in behalf of the City to clear the title to the undug canal land back in January after the City Commission thought it had an agreement with the property owners to buy the land from the City. But the picture changed after the City filed its suit and doubt was raised as to the real ownership of the property. The 100-foot wide undug canal property is located parallel to Parma and Paradiso Avenues and between Granada Boulevard and Orduna Drive. Filing counter suit against the City through their attorney George N. Jahn are Mr. and Mrs. Paul Fischer; Mr. and Mrs. Joel Rosenthal; Mr. and Mrs. Nathan Turner; Dr. and Mrs. John F. Gibby. Mr. and Mrs. Stanley N. Simpson; Mr. and Mrs. Leon Minkoff; Mr. and Mrs. J. F. Swindal Jr.; Mr. and Mrs. Dory Auerbach; Mr. and Mrs. Irving Berman; and Mr. and Mrs. Bernard Supworth. Ten others filed suit to dismiss the City's suit. They are Mr. and Mrs. Sam Lubin; Mr. and Mrs. Maurice M. Greenfield; The Travis Company; Mr. and Mrs. Joel S. Rosenthal Jr. and Mr. and Mrs. Sam Hussein. Meanwhile, Dr. and Mrs. John F. Gibby, 806 Parma Avenue were issued a permit last week to build an $18,265 addition to their home with a 27-foot setback after being delayed for many months by the City Commission on a five-foot setback variance. The Gibbys had contended permits had been granted to other undug canal property owners.
