Consumers Appeals Rate Decision; Could Affect You
Consumers Water Company decided to fight South Miami in District Court of Appeals following a lower court decision which upheld that city's right to lower water rates. The case could result in lower rates for Coral Gables and the county area adjacent to both the Gables and South Miami served by Consumers. This is because the District Court held that South Miami had a right to set its rates based on a system-wide survey of profits. "The decision has been made to appeal," said Ed Kellermann, Consumers vice president, Tuesday. "We were not and are not satisfied with South Miami's position." City Attorney Ted Semple said this week that he will have a report to the City Commission next Monday which will outline the City's legal posture. Metro, meanwhile, has not taken up the decision, according to Assistant County Manager Hoke Welch, a Gables resident. Welch said that he will bring the case to the Commission's attention for its Dec. 19 meeting. Kellerman said Tuesday that much of the company's appeal will pivot around the report of Frank Kelly, court-appointed master who ruled in favor of Consumers, but was overruled by Circuit Judge Joe Eaton. South Miami in 1958 lowered Consumers' minimum from $1.50 to $1.40 after the company has sought to increase it. Consumers got an injunction and went to court to prove it was entitled to more money. A three-year fight resulted with victory for South Miami in Circuit Court. In 1959, a few months after Consumers sought a South Miami increase, it also sought to increase rates in Coral Gables of 17 per cent and jumped the minimum in the County area it served from $1.50 to $1.80. The Gables City Commission ordered the company to show cause why the rates should be increased, but the matter never came to a head as Metro moved in to purchase General Waterworks Corp. and its consumers holdings for $7.1 million and proposed an ordinance freezing rates at the existing level. Negotiations later broke down and South Miami's suit remained a barrier in the way of increased rates.
CD Main Job For Harrison
The appointment of Robert Harrison to be assistant city manager is primarily a Civil Defense job, City Manager L. W. Robinson Jr. explained recently. Harrison's main function will remain personnel director and the City Commission may still appoint acting city managers from time to time in Robinson's absence to carry on regular administrative duties, the city manager said. Finance Director Kenneth Allyn served in that capacity over the weekend following his appointment by the Commission.
