IT'S AN AGE-OLD problem that has faced many local governing bodies — and at last Dade County has found an answer. It took a Circuit Court decision to do it and may settle many future arguments. THE QUESTION is this: Should churches be in residentially or commercially zoned areas? It boils down to this: Should churches be adjacent to store buildings or next to rambling homes? The answer came last week in a decision handed down by Dade County Circuit Court Judge Ralph O. Cullen. THIS IS THE verdict: A church not only has the right, but a duty to be in a residential area. The church in question was St. Thomas the Apostle Catholic parish which wished to build a church, parochial school and residence for sisters on Hardee Road near SW 74th Ave. AFTER THE CHURCH received permission for the buildings, residents of the area filed a suit against the church which prevented construction until a ruling could be handed down by the Circuit Court. The residents argued that such a church-school would disturb the peace of the area and degrade property values. THE COURT THOUGHT otherwise. According to C. Clyde Atkins, attorney for the Diocese of Miami in the suit, expert opinion holds that there would be no depreciation in value of surrounding property. But no matter what Attorney Atkins pleaded or Judge Cullen ruled, there are still those who consider a church-riment to an area? MANY IS THE petition of a church that has been turned down on the strength of opposition by residents who didn't want their property devaluated by the existence of a church or a school or both in the area. If Judge Cullen's ruling had come 10 years sooner there would have been fewer arguments and more church-schools sitting near homes. AND THE PEOPLE couldn't have done a thing. But then, are churches and schools a detriment to an area. In some isolated cases, perhaps yes. But on the whole, we doubt that they are. Proponents of churches in residential areas have long argued that the churches must go to the people. AND THIS IS even more prevalent with the Catholic Church which always combines a church with a school. Wherever one sees a Catholic church, he also will see a Catholic school. And this is as it should be. And there are just as many residents who move into an area because of the Catholic church-school as there are residents who will move out because of this same arrangement. FOR MYSELF and those on planning and zoning boards I have talked with, the church-school belongs on the edge of residential areas, on heavily traversed streets and probably in a zoning for duplexes or apartment houses rather than in single-family zonings. * * * WHILE PLAUDITS are being given out for high school seniors attaining better-than-average heights in just about every field of high school endeavor, let me add my bouquets to those students who during the past year have strived to make the area's high school newspapers, some of the most outstanding in the country. ALTHOUGH EVERY phase of high school work has reached new heights since I received my high school diploma some years ago, the high school newspapers, in my opinion, have shown some of the most pronounced advancements. High school students nowadays seem to be more newspaper conscious. And it shows up in their periodicals. HIGH SCHOOLS now have journalism teachers who guide the progress of the school publication. The school papers do a better job of keeping students informed of school happenings and, altogether, it makes for a better school. When I was in school, newspaper emphasis was on the gossip column and sports. Nowadays, the emphasis is on the students with the highest grades. TWO AREA high schools which are doing outstanding jobs with school papers are Southwest and Palmetto Highs, even though both schools are comparatively young. The stories are interesting, well-written, well-edited, and show the flair of journalists' imagination.
