City Wins Round Over Plumber
The City of Coral Gables won a double victory recently when the District Court of Appeals ruled in its favor against South Miami and James B. Burgin for doing plumbing without a Gables license. Burgin, picked up in 1959, had been the victor in the Circuit Court, but City Attorney Ted Semple won a reversal in the higher court. The victory, also marked the first time a Dade municipality has won a decision over Metro in hundreds of cases of litigation, according to Semple. Ironically, the city had not sought to upset any Metro ordinance, but the District Court of Appeals ruled the municipalities could establish standards higher than the county. As a result, the county last week filed to intervene in the case. Meanwhile, Burgin has some strategy of his own, but he wasn't revealing all the details. "You win one and you lose one," said Burgin. The lower court had ruled, that Burgin, a former member of the Metro Plumber Contractors Board, did not have to take a written exam in Coral Gables since he was covered by a grandfather clause. But, the District Court of Appeals, upheld the city's right to set higher standards than Metro's. Said the court: "Each municipality shall have the authority to exercise all powers relating to its local affairs not inconsistent with the Charter (Metro). "Each municipality may provide for higher standards of zoning, service and regulation than those provided by the Board of County Commissioner in order that its individual character and standards may be preserved for its citizens." But Burgin said he wasn't buying that court's decision and he was going to try to get himself some better law. "I'm going all the way," said Burgin. He said he meant the U.S. Supreme Court, if necessary.

Filling Up Will Be Different
A new Royal Castle restaurant - the fourth for Coral Gables - is planned for 2215 Ponce de Leon Blvd., the site of a former gas station. The building will be located at the northeast corner of Ponce and Giralda Avenue, formerly the site of a Standard Oil Co. station now removed from Ponce.
CG Planning Job Still Stymied By Contract Details
Coral Gables City Commissioners and Rader and Associates are still talking over the details of the contract that will start the planning firm on a comprehensive study of the city's future zoning needs. Rader was selected more than three weeks ago to conduct the $12,000 study, but differences over the scope of the job and certain contractural details have delayed the start of the project. The firm is to study the high rise building and other zoning problems that have stymied the city in recent months. Three months to 120 days is the estimated time of completion for the study.

Mahan Released From Hospital
Leo (Lee) Mahan, candidate in the recent Coral Gables municipal election was discharged from Doctors' Hospital Saturday. Mahan, 53, suffered a choking spell last week in the aftermath of a recent heart attack. Mrs. Mahan praised Firemen Gillum C. Davis Jr. and Andrew N. Benson for their assistance in giving her husband oxygen and emergency aid.
