SM still upset over funds but not enough to sue

By EDWIN KNIGHT Staff Writer The South Miami City Council is still upset over not having been allocated some of the recently distributed federal public works funds, but not angry enough to sue the federal government. Mayor Jack Block on Tuesday, Jan. 4, withdrew a resolution which would have authorized the suit after he disclosed that President-elect Jimmy Carter sponsor another public works funding. "I have heard on very good authority that Carter, when he becomes president, may increase funds for the program," the mayor said, "and I wouldn't want to do anything which would jeopardize the city's chances of receiving any of the funds if the program is carried over." Mayor Block, City Manager Jack Present and most of the council members felt that South Miami was slighted in being passed over for the funds. South Miami wanted $289,000 in its single application, which the city was willing to match with funds from the sale of bonds to improve South Miami Field and Lee Park. If the city had brought the suit, the litigation would have been based on a letter from the government stating that, if a municipality didn't hear anything from the government within 60 days, the city could be assured that it would receive its share of the public works monies. "The only thing I read was in the newspapers," said City Manager Present, "and they all said that South Miami wasn't getting any money." The city manager added that he called the agency which disburses the public works funds, the Economic Development Agency in Atlanta, and found that nothing was coming to South Miami. Councilwoman Mrs. Jean Willis was upset that the city would even consider a suit. "The world is full of attorneys filing suits over one thing or another and I don't think it is right," said Mrs. Willis. "If we do anything, we should write our congressmen, senators and the agency and try to get funds that way." But the mayor countered that even though it is a technicality, he believes that the city should use any means available to keep from using taxpayers' money when federal funds are available.
