City Thinks Court Didn't Read It All

The Dade District Court of Appeals in reversing itself in the suit of South Miami plumber James B. Burgin against the City of Coral Gables because it had overlooked certain Home Rule Charter provisions - overlooked other provisions. This is the crux of City Attorney Ted Semple's appeal for a rehearing before the Court, and if they refuse, to certify a hearing before the Florida Supreme Court as a "decision of great public interest." Burgin was arrested in October, 1959, for doing business without a City license. Burgin, who failed three times to pass a written test for a municipal license, contended that his Metro license, obtained under a grandfather clause, entitled him to a City license upon simple payment of the license fee. Circuit Court Judge Pat Cannon upheld Burgin's contention but was initially reversed by the District Court of Appeals. However, County Attorney Darrey Davis intervened and won a reversal on Oct. 31. In asking for a rehearing, Semple points out that the District Court overlooked Section 5.02 of the Home Rule Charter which gives to each municipality the power to set higher standards of zoning, service and regulation than those provided by the County. Semple also said that the court overlooked the charter preamble which gives municipalities the rights of self determination in their local affairs. A third point raised by Semple is the State Constitution, which he said under the general laws permits municipalities to regulate over county provisions.
