You Just Thought the Canal Matter Was Settled

(EDITORIAL ON PAGE 4) The legal cloud that has hung over the controversial undug canal for approximately three decades may not dissipate without court action, the City Commission decided Tuesday in delaying adoption of an ordinance to sell the land. They ordered City Attorney Ted Semple to file suit in Circuit Court to get a decision on ownership of the undug canal land. The 100-foot wide strip, located parallel to Avenues Parma and Paradiso and between Granada Boulevard and Orduna Drive, was dedicated as a canal but never dug. But the city, which claims ownership, decided Sept. 26 to sell the land to abutting property owners after they agreed they wanted no canal. Meanwhile, Mrs. John F. Gibby, one of the property owners at 806 Parma St., will have to await the court's decision to get a permit to build an addition adjacent to the canal. The Gibby's, first approved and then turned down, have sought a variance to build for several months, but have been delayed by the canal controversy.
