Gables Okays Cops' Writing Tickets Again
Coral Gables has lifted a ban on issuance of traffic tickets in cases involving accidents. The ban was lifted on the recommendation of City Attorney Ted Semple, said Chief William Kimbrough. Semple last year had advised police to make no arrests in cases in which they were not witnesses. This followed a large judgment in Circuit Court in a case of false arrest against a county lawman following an accident. The ruling has had the practical effect of eliminating most tickets by Gables officers since a policeman infrequently witnesses an accident. The ban lasted most of last year and the first two months of this year. A sharp drop off in tickets was immediate and resulted in an exchange of letters between Chief Kimbrough and Senior Judge Jack Turner, who sought an explanation for the drop off. At that time, Chief Kimbrough cited the ban on issuing accident tickets and the fact that the Gables had turned over its motorcycle division to Metro. Kimbrough also raised the question of Metro Court policies which he indicated had affected the morale of his men. Metro Court administers the cases and municipalities receive two-thirds of fines collected. Gables policemen issued 1,757 tickets in 1960 and fewer—1,178 in 1961. The Gables continued to issue fewer traffic tickets than either South Miami or West Miami police. South Miami issued a total of 4,458 tickets last year, compared to 6,461 the year before. West Miami issued 1,400 tickets last year and 2,000 the previous year. "Maybe they have more violators," Chief Kimbrough said of the difference noted. Meanwhile, all three communities showed increases in the number of parking tickets issued during 1961. Coral Gables issued 38,210—nearly 14,000 more than the previous year; South Miami 3,971 — more than double in 1961; and West Miami 162, considerably more than the 38 the year before.
