(Times photo by Maurice Labelle) A suit to block a new Publix Supermarket at 6600 Nervia Street was to be filed this week. Jack Stein, manager of a group of nearby apartments owned by the Santonna-Nervia Corp., said Monday that the papers are being prepared by the law firm of Frank and Weston for filing this week. "They intend to ruin the neighborhood," he said of Publix. Stein said he expects other interested persons to join in the suit or file separate suits to block the market. Publix was issued a $344,-355 permit by the Coral Gables Building Department May 22. This followed controversy over the building of the market itself and then later on where it would be located on the tract and still later over facing. A dozen persons gathered at Stein's home Friday afternoon to discuss their opposition to the market. Present at the meeting were Stein, 445 Bianca Ave.; Mr. and Mrs. Spencer Melton, 6604 Tarrega St.; Mr. and Mrs. C. J. Savage, 6635 Nervia St.; M. Temles, 6605 Nervia St.; Mr. and Mrs. R. W. Sherwood; Mr. and Mrs. Isidore Stein, 6565 Santona St. Opponents charge that the City allowed improper setback of five feet on Nervia which should have been 15 feet, the same as required for the Santona Nervia Apartment which lies just northeast of the market. They seek to force Publix to erect a 20 to 30 foot high decorative wall along the apartment and Nervia Street side to block out noise. Openings on Nervia Street are also opposed because residents fear they will be used for loading and unloading trucks on that side. Publix originally sought to utilize two tracts separated by an alley to build the market. But neighbors objected to that, too and the City Commission reversed an earlier move vacating the alley to create the unified tract. Publix was then forced to build on either one tract or the other and decided on the land bordered by Nervia, Monza Avenue and the alley, utilizing the remainder of the property for parking. The land is zoned for markets, but some of the objectors claim that a "supermarket" is not included in the intended use. Witters Construction Co. was awarded the contract and the land has been cleared for construction. Architect is Charles N. Johnson and O. K. Houston Jr., associate architect.

Deaths in the Gables / Dr. Quillian's Mother Dies, 77

Private services were held Monday at Philbrick's Coral Gables Chapel for Mrs. Cleta Quillian Cleveland, 77, of 1109 Palermo Ave., who died Sunday. A member of the English Department at Miami High School, she taught in the Dade County School system from 1928 until her retirement in 1956. She came here in 1925 from Elberton, Ga., and was a former member of Phi Mu Sorority and its province president. She was a member of the D.A.R., the U.D.C. and of the Coral Gables First Methodist Church. She is survived by two sons, Dr. Jack Q. Quillian and Harry Lee Quillian; and three brothers, including Dr. Warren W. Quillian.

Doctor's Wife Died Sunday

Services were held Thursday in Philbrick's Coral Gables Chapel for Mrs. Marie Louise Derendinger, 83, of 701 Sevilla Ave., who died Sunday. Interment was in Flagler Memorial Park. She came here 16 years ago from Salisbury, N.C. and leaves her husband, Dr. Ernest Derendinger, and a brother, Andrew Reif of Miami.

Tax Assessor Tommy Blount was to enter Doctor's Hospital Wednesday for observation and tests for a stomach ailment.

Former Pupil To Celebrate Sunday Mass

Father John Joseph Dunne Jr. returns to the parish from which he was graduated from junior high school Sunday to celebrate his first solemn mass as a newly ordained priest of the Roman Catholic Church. Father Dunne, the son of John Joseph Dunne Sr., 737 Valencia Ave., was graduated from St. Theresa's school in 1950. A native of Miami, he will be ordained the day before by Bishop Coleman F. Carroll at St. Mary Cathedral in Miami. The ordination ceremony has been scheduled for 11 a.m. Sunday at 10 a.m., Father Dunne will celebrate his first mass at the Church of the Little Flower.

Mrs. Tomlinson, Lived on Obispo

Services for Mrs. Julia Tomlinson, 86, of 1320 Obispo Ave., who died May 24, were held Saturday at Van Orsdel's Coral Gables Chapel with interment in Flagler Memorial Park. Mrs. Tomlinson came here 12 years ago from Salisbury, N.C. and was a member of the First Methodist Church of Coral Gables. She leaves two daughters, Miss Nell Tomlinson of the above address; Mrs. Fred H. Stewart Sr., and a son Robert E. Tomlinson, Grand Bahama Island, and three grandchildren all of Miami.

Mrs. Davis, 80, Came Here in '51

Funeral services were held Saturday at Philbrick's Coral Gables Chapel for Mrs. Lillian A. Davis, 80, of 1314 Salzedo St. She died May 23. Mrs. Davis had lived here since 1951. She was formerly a resident of Newton and Boston, Mass. A widow, she is survived by three daughters; Miss Dorothy Davis, 230 Salamanca Ave.; Mrs. Charles Malinoski, 1240 Obispo Ave.; and Mrs. Ardoin Casgrain, Washington, D.C., a

Paul School Is Elected Head of Merchants' Unit

Paul School, owner of Irene Shop, has been elected chairman of the Retail Merchants Division of the Chamber of Commerce. School succeeds Sam Miller, general manager of Sears and Roebuck on Coral Way. Mrs. Madeline McEldowney of Elliott's Stationers was elected vice chairman. PAUL SCHOOL ... Merchants' leader Elected to the board of directors for two-year terms are Ruth Boyle, Albert Friedman, Robert Moorman, Martin Nash and Albert Swiren. Elected for a one-year term are John Gurley, Mace Harris, Marulce Marco and Al Panetz. At a special meeting with his his new board, School will also appoint an executive committee. The committee in turn, working with the board, will appoint 10 additional members to the board of directors.

BIDDERS ON GABLES TAX CERTIFICATES Tax Certificates Bring $31,491 Cool, calm and "collection" marked the annual tax sale Friday, according to T. H. Cleary, the City's tax collector. This was the second "quiet" tax sale since the bitter session two years ago when professional tax buyers charged the City with improper procedure in handling the sale. The procedure has been tightened up since. Cleary reported that $31,491 in tax certificates were sold, with one man, N. W. Siegel, accounting for one-third, or $10,076. Unsold because of pending litigation was the $3,650 real estate tax certificate on the Riviera Day School, which is appealing a decision of a lower court that it must pay taxes because it failed to meet tax exempt criteria. In all, 260 certificates - 19 more than reported last year - were sold. Thirty-five persons attended the sale and 16 were successful bidders, Cleary said. Lowest interest bid on any of the certificates was 2 7/8 percent and ranged up to 12. Certificates were on real estate, waste, sewer, lot clearing and street and alley paving. Assisting Cleary in the sale were Donald Lebrun, deputy tax collector, W. E. Gill, deputy tax collector and Mrs. Jean Wilkinson, clerk.
