State Says; Arden Says; Court Says

A Coral Gables bar and grille owner has answered a State Road Department ultimatum to remove his awning by filing suit in Circuit Court against both the SRD and City of Coral Gables. Don Arden, owner of Casa Le Jeune, 4521 Le Jeune Rd., said yesterday that he has been trying to get the matter settled for 14 months. Feb. 8 he got a letter from George F. Meier, director of rights of way for the SRD, giving him 10 days to take down the awning. Meier told Arden that the awning, which juts out more than a foot and a half over Le Jeune Road, is illegally in the right of way, that it constitutes a danger and the state has no way of reimbursing him. The letter resulted from a direct appeal by Arden to Gov. Farris Bryant Jan. 10. In that letter, Arden told of his long struggle with the City, County and State to get compensation for the awning, legally erected five years ago for $640.

AF Wants More Space In Gables

Air Force Recruiting Detachment 303 is overcrowded and looking for a new home in Coral Gables. The unit is located in the Rogers Building, 299 Alhambra Cir., and has outgrown its facilities. Says Maj. Aubrey L. Ross, commanding officer: "We were a little crowded and asked for more space." They have 12 employes. General Service Administration's Atlanta office recently advertised for a 1,230-foot location with close proximity to eating and public places. They'd like a ground floor. Target date for moving is April 1. While no recruiting is carried on, the detachment sees to it that the 16 recruiting stations in Central and South Florida, under its jurisdiction, continue to provide the Air Force with a steady flow of recruits. The operation was moved to Coral Gables three years ago from the Miami Post Office Building.

Parking Fee Goes From $3 to $5

It'll cost you $5 a month to park in the City-owned off-street parking lot on Alcazar Avenue instead of $3. A drop in revenue was blamed by the City in jacking up the price. Other lots will remain at $3. This lot is used as an employe parking lot. There are no meters, no tickets and users may park there all day for the price of the $5 windshield sticker.

Sakolsky Is Now Building 13 Stories in Court

The City and A. H. Sakolsky squared off once again Wednesday on his battle to get his 13-story high rise apartment at 720 Biltmore Way. His arguments were heard by the District Court of Appeals. Sakolsky tried unsuccessfully last September to have the Circuit Court tell the City to issue him a permit, but Judge Irving Cypen dismissed his suit. The District Court is hearing the appeal of Judge Cypen's ruling. The controversy began with a 3-2 vote of the former City Commission to grant Sakolsky permission to go higher than anyone else has since the Miami Biltmore Hotel (Veterans Hospital) was built in 1926. This proved an unpopular decision which was reversed when Commissioner Winston W. Wynne resigned to join the Metro Commission and Commissioner James Hess, appointed to take his place, voted the other way after Commissioner Joe Murphy moved to rescind the action. Sakolsky claimed he was robbed of the right to build the high rise apartment and went to courrt. The District Court of Appeals is not expected to rule immediately.

Big Judgment Against City Is Ordered Paid

Payment of $32,000 to a contractor and $13,800 to the court in which he brought a suit against the City has been authorized by the City Commission. Contractor Morris Prosser was awarded this judgment against the City by the District Court of Appeals after the Florida Supreme Court refused to hear the case involving the SS-1 sewer system. Prosser, a general contractor who hired Contractors of Florida to do the work for him, claimed that the City was withholding funds due him for the work. The City, through its attorney, Ted Semple, claimed that the work done by Prosser was defective, and has had to spend hundreds of thousands of dollars in repairs. Prosser said the work had been accepted by City engineers. Meanwhile, Semple said Tuesday that it may still be possible to recover the loss, but
