Sunrise Association Protests City's Action

(Continued from page 1) bour, was presented to the City Commission asking that the emergency ordinance be rescinded. It also developed that the draft ordinance was in error in two sections, one giving part of the reason for the change, and another outlining the changes in apartment units permitted. It also developed that the published legal was in error and also a memo to the zoning director outlining the decision of the City Commission contained errors. "For no apparent reason you've jumped the gun," Howard Scharlin, 3615 Battersea Rd., told the Commission. Evans jumped him and told him he did not have his facts straight. The newly appointed vice mayor and Commissioner Joe Murphy joined to trace the series of events that led to the change in the zoning requirements: 1. Schainuck's attempt to get a permit. 2. Denial by the Building Department. 3. Schainuck request to the Zoning Board. 4. Denial by the Zoning Board. 5. Request to the City Commission and approval. Schainuck, a former member of the Zoning Board, was "unnecessarily delayed" for three months because City Attorney Ted Semple ruled that he was not bound by the three obsolete resolutions repealed by the emergency ordinance. The ordinance, they pointed out, merely cleared the deck and created new restrictions that protected residents. This, the association said they were not buying. They claimed: 1. They should have been notified of the changes because in effect, changing the number of units permitted involved a zoning change. 2. Changing the parking requirements, different from the zoning code, involved a change in zoning. The controversy stood at an impasse when the long item drew to a close.
