And for University Motel, Too? Liquor Seen for New Inn Here

Will the new Holiday Inn at 1350 South Dixie Highway be eligible for a liquor license? "Yes sir, if they are a 100-room hotel, they will be eligible," said City Manager L. W. Robinson Jr., this week. Robinson, qualified his answer, however by saying that the City Commission may grant the license, but it is not incumbent upon them to do so. The owners and operators must be qualified in the eyes of the Commission, he said. "Each license stands on its own merits," said Robinson. Owner Ben Gaines, is planning to erect a 150 to 200 room, three-story hotel and penthouse. He is planning a cocktail lounge and restaurant that will sell alcholic beverages. The old Miami Biltmore Hotel - now the VA Hospital here - was the only hotel ever to qualify for a liquor license under the City Charter. Private clubs such as the Coral Gables Country Club do have licenses, however. Albert Singer, owner of the University Court Motel, has been trying to several years to obtain a beverage license without success. If Gaines succeeds, Singer is expected to press the issue. The two hostelries will be on adjacent corners and each is commonly known as a motel. The word "motel" is in the title of Singer's establishment. It is not known if it will be included in the title of Gaines' unit. The previous City Commission considered interpreting the word "hotel" in the Charter to include "motel," but never followed through with the idea. Another charter proposal also failed to happen. It would have made motels of 100 or more room eligible for liquor licenses. There have been no indications that Gaines would not get his license when he applies for it. Recent lawsuits indicate that the City's power to refuse is pretty much limited to its charter provision on number of rooms, restaurants, seating requirements or sanitary and other facilities in restaurants. Court decision have given to to the State Beverage Department the main responsibility for deciding on qualifications of applicants. Meanwhile, Gaines ran into trouble with the Board of Architects which turned back for redesigning the drawings submitted by MacKay and Gibbs, architects. Final plans have not yet been presented to the Zoning Board, but the Board was split in its recommendations to the City Commission on various proposals involving variances on preliminary plans. Gaines sought to have: Sliding door exits from roms to pool and patio area. Twelve one - bedroom apartments with kitchen facilities. Parking for 157 cars in the setback area. A 2,000 square foot penthouse for use as a steam room and solarium. The board recommended that the doors be permitted on the first floor only, but that rest of the request be denied. A half dozen area residents protested various aspects of Gaines' proposals.

Semantics, Maybe?

The terms "hotel" and "motel" don't seem to revolve so much around what an owner says his unit is as to its architectural features. A hotel, by the Gables' definition, is one that has doors leading to a hall and lobby rather than directly outside. The latter is a motel, the City holds.
